These terms cover the Cognitive Atoms beta. They are deliberately short and plain, because terms nobody reads protect nobody.
By installing or using Cognitive Atoms you agree to these terms. If you do not agree, do not use it.
Cognitive Atoms is in beta and is provided “as is”. It may contain defects, change substantially, or be discontinued. Do not rely on it as the only copy of anything you cannot afford to lose. Keep your own backups.
You must be at least 13 years old, and old enough to form a binding contract where you live.
You retain all rights to the thinking you capture. We claim no ownership of it and no licence to use it.
Where it is stored depends on how you run it. In local-only mode it is stored on your device and we do not receive a copy. With a hosted account (beta), what you capture is stored on our servers and we hold a copy of it. That copy is scoped to your account at the database layer, is used only to provide the service to you, and is never sold and never used to train AI models. You can delete it yourself, along with the whole account, from inside the product; §4.5 of the Privacy Policy says exactly what deletion removes and what it does not.
You are responsible for what you choose to capture, including making sure you are permitted to record anything involving other people.
AI features require you to connect your own provider account or key. Charges from that provider are yours. Their terms govern their handling of what you send them. We do not resell provider access and do not fall back to a key of ours. In local-only mode the key you connect stays on your machine. With a hosted account you send it to our server, because our server is what calls the provider for you; it is stored encrypted at rest in a slot belonging to your account, is never used to serve another account, and is deleted when you delete your account.
Do not use Cognitive Atoms to break the law, to infringe anyone’s rights, or to attack the service or other users. Do not attempt to use the relay described in our Privacy Policy as general-purpose network infrastructure — it exists to connect an AI app to your own machine and nothing else.
We operate a relay so AI apps can reach the Cognitive Atoms instance on your machine. It forwards encrypted traffic it cannot read. We do not guarantee its availability, and we may change or discontinue it. If it is unavailable, the software on your machine continues to work — in local-only mode your cognition is on your device, not behind the relay. A hosted account is different: it is served by us, so while our service is down your hosted cognition is unreachable until it is back.
Cognitive Atoms includes open-source software, each under its own licence. Those licences govern those components and nothing here limits your rights under them.
Apart from your own content and the open-source components, Cognitive Atoms and its underlying technology remain ours. These terms grant you a personal, non-exclusive, revocable licence to use the software during the beta.
You may stop using Cognitive Atoms at any time by uninstalling it. We may suspend or end beta access, with notice where practical. Your local data remains yours and stays on your machine. Uninstalling does not delete a hosted account: to remove the copy we hold, delete the account from inside the product as described in §4.5 of the Privacy Policy.
To the fullest extent the law allows, Cognitive Atoms is provided without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages, or for lost data or lost profits. Nothing here excludes liability that cannot lawfully be excluded.
We may update these terms. If a change is material we will say so rather than quietly changing the date.
